Second Tree is committed to protecting individual privacy and securing the personal information made available by users of Second Tree’s website as well as Second Tree web pages on other sites (such as Second Tree profiles on social networks). By visiting Second Tree’s website you are accepting the provisions set out in this policy.
Any information voluntarily disclosed to Second Tree by users of the Second Tree website is held with the utmost care and security and will not be used in ways other than as set forth in this privacy policy. Through this website you may reach or be directed to other sites that relate to Second Tree, such as the sites of our national partners which are fundraising on behalf of Second Tree. All these sites have their own privacy statements which are similar to this one but may vary slightly.
This privacy policy has been compiled to help users understand how their information is being used online, what information we collect, why we collect it, and how users can update, manage, export, and delete their information. What personal information do we collect when you elect to subscribe to our newsletter or when you select the “keep me updated on what is happening with Second Tree” option when making a donation?
Providing information is your choice. When you undertake certain actions on our website, such as donating, signing up for our email newsletter, or filling in a form to register your interest in our activities, you knowingly provide us with personal information about yourself, such as your name, email address, postal address and other information. When you select to be updated on what is happening with Second Tree, or when you expressly input your information to subscribe to our newsletter, you will be generally asked to enter your name, email address and country. We collect your personal information only to the extent that it is relevant and limited to ensure we can email you our newsletter, we can contact you to let you know about any news or events related to Second Tree, or other similar marketing purposes.

We collect information from you when you subscribe to Second Tree’s newsletter by inserting your information to register for our newsletter, or when you click on “keep me updated on what is happening with Second Tree” while making a donation, or when you otherwise contact us.
How do we use your information?
We may use the information we collect from you when signing up for our newsletter, or use certain other site features in the following ways:

This data is not stored or reused by such service providers and is only held for the duration of the matching process. How do we protect your information?
When signing up for our newsletter or requesting to be updated when making a donation, your information is stored in GiveWP (https://givewp.com/) and/or Mailchimp (https://mailchimp.com) or other similar providers. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential. While Second Tree does not own or control GiveWP and Mailchimp or other third party providers, Second Tree only uses websites/providers that ensure your information is secure (for more information regarding the steps taken by GiveWP and Mailchimp to ensure the security of the information stored on GiveWp or Mailchimp, please visit https://givewp.com/ and https://mailchimp.com/about/security/). You acknowledge and understand however that your information will be stored on Mailchimp or GiveWP and that Second Tree does not own, supervise or otherwise control Mailchimp, GiveWP or other third-party providers that Second Tree may elect to use. You agree that Second Tree shall not be responsible for any act or omission of GiveWP or Mailchimp or other third-party providers.
In addition, our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.
Do we use ‘cookies’?
Yes. This does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or serving our users, so long as those parties agree to keep this information confidential. We may also release information when its release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property or safety.
We may share your personal information (i) with our agents or service providers including digital advertising agencies or social media companies that perform services on our behalf for the purpose of sending you communications on Second Tree’s activities, performing direct marketing or completing a donation transaction that you initiate; (ii) with our national partners who help us raising money for refugees and other not-for-profit activities. With these fundraising partners we also share anonymized data gathered through cookies when you visit our website for them to offer customized contents to their audience. In no case will any sensitive financial information be shared. We will always keep your information safe, and we will never sell or swap your information with any other third party.

Occasionally, at our discretion, we may include or offer third-party products or services on our website. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.
Google’s advertising requirements can be summed up by Google’s Advertising Principles. They are put in place to provide a positive experience for users. (Google Ads policies – Advertising Policies Help). We use Google Analytics on our website.
Google, as a third-party vendor, uses cookies to serve ads on our site. Google’s use of the DART cookie enables it to serve ads to our users based on previous visits to our site and other sites on the Internet. Users may opt-out of the use of the DART cookie by visiting the Google Ad and Content Network privacy policy.

The processing of your information is necessary to receive news and marketing messages about Second Tree. This processing is required for the administration of our business, and the provision of our services, which is necessary for the legitimate interests of our business.
Second Tree commits to only collecting data and information that is strictly necessary to send news and marketing messages. When personal information is required, the User will be asked to voluntarily incorporate said information and will be informed of the identity of the compiler, the purpose of the collection, as well as the possibility and procedures to exercise the rights of access, rectification, cancellation and opposition (ARCO rights).
When you sign up for the newsletter, we can send marketing messages (our newsletter) to you by email. You can stop receiving such messages any time by clicking on the “Unsubscribe” link in any of such emails or by contacting us.
Who will receive your information?
We do not sell any of your personal data. To be able to provide our services to you and to run our business, we share data with third parties from the following categories:

Rights the User can exercise are:
1) Right of access to the interested party’s personal information. The User can obtain confirmation on whether Second Tree handles personal information concerning him
2) Rectification right, that is, the User has the right to request a rectification of inaccurate information.
3) Right to withdrawal. The User can request that the Second Tree stops processing their information without undue delay, among others, because these have ceased to be necessary, the consent has been withdrawn, etc.

Security measures
Second Tree will treat all the information under the strictest confidentiality, applying technical and organizational security measures that are in compliance with current laws and regulations.
Second Tree has established all the technical means at its disposal to prevent the loss, misuse, alteration, unauthorized access and theft of the data provided by the User through the Website.
Second Tree will also implement appropriate measures to ensure that your personal information remains protected and secure when it is transferred outside of your home country, in accordance with applicable data protection and privacy laws. We only work with trusted services that can ensure the safety of your personal data.
How long we store your data depends on legal or regulatory requirements (e.g. tax authorities require certain transactional data to be stored for 10 years), or if it may be necessary to resolve disputes, prevent abuse or fraud, or enforce our terms and conditions. We also hold on to parts of your data, which we deem helpful to keep developing our business – unless you request us to delete such information. For instance, the identification information offered by the User to register will be kept until the owner requests deletion, the identification information offered by the User when registering for the newsletter or contacting Second Tree will be kept until the User’s request is fulfilled by Second Tree.

Do we share Information we Receive?
As described above your information may be shared with affiliated businesses or with third party partners that help us provide our services, and when required by law. For instance, we may share your information with service providers who perform services on our behalf, including to measure and optimize the performance of ads and deliver more relevant ads and we may share your device and usage information to help us and prevent fraud.

In the preceding twelve (12) months, Second Tree has not sold personal information.
Your Rights and Choices
The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights. You have the following rights under the CCPA:
- Right to request Second Tree to disclose Personal Information, or Categories of Personal Information, it collects, uses, discloses, and sells (Access to Specific Information and Data Portability Rights)
- Right to request Second Tree to delete Personal Information we have collected from you (Deletion Request Rights)
- Right to request Second Tree opt you out of the sale of your Personal Information (Personal Information Sales Opt-out and Opt-in Rights)
Deletion Request Rights
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing relationship with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Personal Information Sales Opt-Out and Opt-In Rights
We do not generally sell your information. However, in the event we do, if you are 16 years of age or older, you have the right to direct us to not sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time. To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by contacting us at admin@secondtreeus.org.
Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by visiting our website and sending us a message. We will only use personal information provided in an opt-out request to review and comply with the request.
Exercising Access, Data Portability, and Deletion Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by completing the webform available here or mailing us at: admin@secondtreeus.org.
The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
The following is our process for Verifying a Request:
Request to Know Categories of Personal Information: We will verify your identity to a “reasonable degree of certainty” by verifying at least two data points that you previously provided to us and which we have determined to be reliable for the purpose of verifying identities.
Request to Know Specific Pieces of Personal Information: We will verify your identity to a “reasonably high degree of certainty” by verifying at least three pieces of Personal Information previously provided to us and which we have determined to be reliable the purpose of verifying identities. In addition, you will be required to submit a signed declaration under penalty of perjury stating that you are the individual whose Personal Information is being requested.
Request to Delete: We will verify your identity to a “reasonably high degree of certainty” by verifying at least three pieces of Personal Information previously provided to us and which we have determined to be reliable for the purpose of verifying identities. In addition, you will be required to submit a signed declaration under penalty of perjury stating that you are the individual whose Personal Information is being requested.
If we are unable to verify your identity to the applicable standard, we will treat your request to delete as a request to opt-out of the sale of the personal information that you provided as part of processing the request to delete. See the following section for a description of the right to opt-out of the sale of personal information.
Response Timing and Format
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically by electronic mail communication.
We will endeavor to respond within 15 days from the date that you submit the opt-out of sale request. The CCPA does not require that we verify the identity of individuals who submit requests to opt-out of sales. However, we may deny the request if we have a good-faith, reasonable, and documented belief that the request is fraudulent. If we deny the request on this basis, we will notify the requesting party and provide an explanation why we believe the request is fraudulent.
Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for services or a different level or quality of services.
However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Users can visit our site anonymously. Once a privacy policy is created, we will add a link to it on our home page or as a minimum, on the first significant page after entering our website. Our Privacy Policy link includes the word ‘Privacy’ and can easily be found on Second Tree website.
Any information we collect is covered by the Privacy Policy in effect at the time the information is collected. We may revise this Privacy Policy from time to time. If we make any material changes to the Policy, you will be notified of any Privacy Policy changes on our Privacy Policy Page, where we will update the “Last Updated Date” at the bottom of the Privacy Policy to indicate when changes became effective.
How does our site handle Do Not Track signals?
We honor Do Not Track signals and Do Not Track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.

Minors (Children Online Privacy Protection Act – “COPPA”)
The Children’s Online Privacy Protection Act (“COPPA”) applies to children under 13 years old.
Second Tree’s newsletter is not designed for children under the age of 18. However, we do not request users to provide a date of birth, or otherwise monitor the age of the users signing up for our newsletter. In case a minor subscribes to SECOND TREE’s newsletter, we will collect the minimum amount of information regarding the minor that is necessary to the provide our newsletter service and marketing messages. We will allow parents to review and delete their children’s information.
This policy does not apply to websites or services or practices of companies that we do not own or control, such as third-party services children might access through links or other features (e.g., social media buttons). These other services have their own privacy policies, and we encourage parents and children to review them before providing them with personal information.
By using our website and subscribing for our newsletter or otherwise interacting with our webpages you acknowledge that you accept and agree to this Privacy Policy.

Fair Information Practices
The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Our Privacy Policy is designed to comply with such Principles.
Specifically:
- We will be transparent and will provide notice regarding the collection, use, dissemination, and maintenance of PII in this Privacy Policy.

CAN SPAM Act
The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations. Our Privacy Policy is designed to comply with the CAN-SPAM Act.
